America PAC was incorporated in Texas on May 22, 2024, with Chris Young — a Texas-based Republican campaign finance lawyer who operates under the name Chris Gober — listed as founding treasurer ¹. The PAC registered with the FEC as an Independent Expenditure-Only Committee (Super PAC) under the identifier C00879510 ¹. In July 2024, Phil Cox, a co-founder of political consulting firm GP3 LLC, joined along with colleagues Peck and Rexrode in guiding roles at the PAC Connection #2636.

Per TX Comptroller records, the PAC's operational spending flowed through four Musk-controlled Texas LLCs. United States of America Inc (TID 32097038932) and Group America LLC (TID 32097028388) were both formed on October 2, 2024, at the same registered address (2025 Guadalupe St Suite 260, Austin TX), with Musk listed as President of USA Inc and Jared Birchall as Secretary. USA Inc is the sole member of Group America LLC. Europa 100 LLC (TID 32075024482) and Excession LLC (TID 32075024201) are older Birchall-managed entities formed July 14, 2020, both using PO Box 341886 Austin TX and Registered Agent Solutions Inc ⁴.

FEC Schedule A receipts show a bidirectional financial relationship: United States of America Inc contributed $47.9 million to America PAC across 12 contributions between November 2024 and June 2025, while America PAC simultaneously made $78.3 million in in-kind contributions back to USA Inc. Additional FEC-documented donors from the Musk entity network include Europa 100 LLC ($3,811), Group America LLC ($3,752 across 4 contributions), Excession LLC ($2,324), 333 Main LLC ($2,840), and the Elon Musk Revocable Trust ($3,425) ⁶, Connection #3028.

America PAC's voter payment programs generated legal challenges across multiple jurisdictions. The PAC offered $47 payments to registered voters in swing states who signed a petition supporting First and Second Amendment rights, later increasing to $100, and ran $1 million daily lottery-style giveaways ⁹.
